As soon as you discover termite damage or ongoing infestation—especially if you’ve already contracted with a pest control company to protect your property. Many termite cases turn on contract language, inspection practices, and compliance with statutory duties, none of which are obvious on first glance. An early review can help protect your rights and preserve evidence.
Common red flags include continued infestation after treatment, refusal to re-treat or repair damage, missed or incomplete annual inspections and/or inadequate treatment reports, unexplained coverage denials, or reliance on confusing contract provisions to avoid responsibility.
In Florida, termite companies are subject to strict statutory and regulatory requirements, and many defenses they raise do not hold up under close legal scrutiny.
Do not assume the denial is final. Both insurance companies and pest control companies frequently deny valid claims at the outset. It is important to have the policy or contract reviewed to determine whether the denial is legally supportable and whether additional remedies are available.
Document everything. Take photographs and videos, retain damaged materials when possible, and preserve all contracts, inspection reports, and treatment records. Avoid canceling service agreements until you receive legal guidance, as doing so can unintentionally compromise your claim.
