  1. Confirm the basis of denial. Look for the exact section of the policy or contract they are citing. Is it an exclusion? A failure to meet a deadline? Once you identify the “why,” a lawyer can determine if that interpretation is actually supportable under current Florida statutes.
  2. Check the statute of limitations. Florida law generally requires you to file a lawsuit for negligence within two years of the date of loss and five years from the date of a contract breach.   4. File a complaint against the pest control company with the Florida Department of Agriculture and Consumer Services. The complaint effectively creates a litigation hold as the Department will collect and copy the pest control company’s records, preventing them from destroying evidence.
